A failed or refused DOT drug or alcohol test removes a driver from safety-sensitive duties immediately. Since the FMCSA Drug and Alcohol Clearinghouse launched in 2020, violations are recorded in a federal database that employers must check before hiring CDL drivers and annually after. The only way back to safety-sensitive work is the DOT Substance Abuse Professional (SAP) process, also called the Return-to-Duty (RTD) process.

The Six Steps of the Return-to-Duty Process

Under 49 CFR Part 40, every driver must complete these steps in order. No employer can return a driver to safety-sensitive duties until all are done.
1. Initial SAP evaluation. A qualified SAP meets with the driver face to face, reviews the violation, and assesses substance use history. This is usually completed within 1–2 days.
2. Education or treatment recommendation. The SAP prescribes a program based on the clinical evaluation. Recommendations are individualized, not one-size-fits-all.
3. Completion of the recommended program. The driver must finish it exactly as directed. Length varies from a few days to several weeks.
4. Follow-up SAP evaluation. The SAP confirms the driver has complied and reports the driver as eligible for RTD testing.
5. Return-to-Duty test. The driver must pass a directly observed DOT drug or alcohol test. The employer or C/TPA schedules this test, and can do so only after the SAP has cleared the driver in the Clearinghouse.
6. Follow-up testing. After returning to work, the driver undergoes random, unannounced testing as directed by the SAP.
How the Clearinghouse Status Works
• After the initial evaluation, the driver's status remains "Prohibited" even once the SAP enters the plan.
• Status changes to "Not Prohibited" only after the driver completes treatment or education and the SAP uploads the Follow-Up Evaluation and Eligibility for RTD Testing report.
• The Clearinghouse never deletes violations. Employers will always see the violation, but they can also see whether the driver completed the process correctly. A completed record is far stronger than an unresolved one.
• Once the initial assessment is logged, the driver cannot change SAPs. Before that point, a change is possible: directly if the request hasn't been accepted, or by calling the FMCSA Clearinghouse if it has. Drivers should choose carefully at the start.

Who Must Complete the Program

Any employee in a DOT-regulated safety-sensitive position, including:
• Commercial truck drivers (FMCSA)
• Aviation employees (FAA)
• Transit operators (FTA)
• Pipeline workers (PHMSA)
• Maritime workers (U.S. Coast Guard)

What Happens After Completion

Drivers who finish the process can legally return to driving a commercial motor vehicle, resume work with their current or a new employer, clear their Clearinghouse "Prohibited" status, protect their CDL from permanent downgrade, and show compliance to employers and insurers. Many carriers will hire SAP-compliant drivers if the RTD test is complete, follow-up testing is active and compliant, and the driver is upfront about their status.

The Cost of a Second Violation

A second failed or refused test means immediate removal from duty, a new SAP evaluation from the beginning, a longer and stricter follow-up testing program, and significantly reduced employment options.

Common Mistakes That Delay Drivers

• Misunderstanding employment status requirements and how they affect the process
